Whilst 5 Star Motor Cruisers Pty. Ltd. (5SMC) uses all reasonable efforts to include accurate and up to date work
practices 5SMC makes no warranties or representations with respect to any damages caused to its customer's vessels
whilst in its care or control. 5SMC accepts no responsibility or liability whatsoever arising from or in any way
connected with the use of its customers vessels. In particular, 5SMC will not be liable for any damage, theft or loss
of property from a vessel under the control of 5SMC. 5SMC reserves the right to determine its responsibility whether
the result of actions or omissions of an entity of 5SMC or a third party.
While the utmost of care is taken, 5SMC does not accept any responsibility or liability for any product, person,
accident, incident or injury that may occur during our service to you, your friends and relatives or your vessel or
event.
You agree to hold harmless and indemnify 5SMC from and against any loss, damage, expenses, payments, costs (including
costs of any settlement), claim, demand, action or proceeding that may be made against or incurred by 5SMC arising out
of or in relation to the performance of your obligations or failure to perform your obligations under this agreement.
You are financially responsible for any loss or damage sustained by 5SMC caused by you, your friend and relatives or
your vessel whilst in attendance by a contractor prior to, during or after any service performed. 5SMC does not accept
responsibility or liability for any person, contractor or any other person that may sustain an injury or any other
ailment while on the marina property.
